1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of the websites, newsletters, mobile experiences, and any other online services operated by ApexReport (“ApexReport,” “we,” “us,” or “our”) that link to these Terms (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, you must not access or use the Services.

2. About the Services

ApexReport is a media company covering luxury real estate, architecture and interior design, furniture and appliances, business, distinctive cars and superyachts, aviation and luxury travel, and fashion. The Services may include articles, videos, newsletters, comment sections, sweepstakes, and event listings, among other features that ApexReport may add, modify, or discontinue at any time without notice.

3. Eligibility

You must be at least 13 years old (or 16 in the European Union or United Kingdom, or the minimum age required in your jurisdiction) to use the Services. If you are under the age of majority in your jurisdiction, you may use the Services only with the involvement of a parent or legal guardian. Some features, such as sweepstakes or event registration, may have additional eligibility requirements described in the applicable rules.

4. Accounts and Registration

Certain features of the Services, such as commenting or newsletter subscriptions, may require you to register or provide contact information. You agree to provide accurate, current, and complete information, and to keep such information up to date. You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account.

5. License to Use the Services

Subject to your compliance with these Terms, ApexReport grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material on the Services, except as follows:

  • Your computer or device may temporarily store copies of such materials incidental to your accessing and viewing those materials.
  • You may print or download one copy of a reasonable number of pages for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
  • You may share links to our content on social media or via email, provided such sharing does not imply endorsement by ApexReport without our consent.

All other use of content from the Services requires our prior written permission. ApexReport reserves all rights not expressly granted in these Terms.

6. User Content

The Services may allow you to submit comments, reviews, photos, or other content (“User Content”). By submitting User Content, you grant ApexReport a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Services and ApexReport’s business, including for promotional purposes, in any media now known or later developed.

You represent and warrant that you own or have the necessary rights to submit your User Content, and that your User Content does not violate the rights of any third party or any applicable law. ApexReport does not control and is not responsible for User Content, and does not endorse any opinions expressed by users. We reserve the right, but do not assume any obligation, to review, edit, remove, or refuse to post any User Content at our sole discretion.

7. Prohibited Conduct

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
  • Post or transmit any content that is defamatory, obscene, harassing, hateful, or otherwise objectionable.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Use any robot, spider, scraper, or other automated means to access the Services for any purpose without our prior written consent.
  • Interfere with or disrupt the operation of the Services or servers or networks used to make the Services available.
  • Attempt to gain unauthorized access to any portion of the Services or any systems or networks connected to the Services.
  • Upload or transmit viruses, malware, or other malicious code.
  • Use the Services to send unsolicited advertising, spam, or promotional materials.
  • Collect or harvest any information about other users of the Services without their consent.

8. Comments and Community Guidelines

If you leave a comment on an article or other content, please keep your comments relevant, respectful, and on-topic. ApexReport reserves the right to remove any comment, and to suspend or terminate a user’s ability to comment, at our sole discretion and without notice, including for content that violates Section 7 (Prohibited Conduct) or that we otherwise determine to be inappropriate.

9. Sweepstakes, Contests, and Promotions

From time to time, ApexReport may offer sweepstakes, contests, or promotions (“Promotions”) on the Services, which may relate to our coverage areas such as luxury travel, automotive experiences, or design products. Each Promotion will be governed by its own official rules, which are incorporated into these Terms by reference. In the event of a conflict between these Terms and the official rules of a specific Promotion, the official rules will govern for that Promotion. Promotions may be sponsored or co-sponsored by third parties, whose own terms and privacy practices may also apply.

10. Intellectual Property; Copyright (DMCA) Policy

All content on the Services, including text, articles, photographs, graphics, logos, and the compilation and arrangement thereof, is owned by ApexReport or its licensors and is protected by copyright, trademark, and other intellectual property laws. The ApexReport name and logo are trademarks of ApexReport and may not be used without our prior written permission.

Copyright Complaints (DMCA)

If you believe that content on the Services infringes your copyright, please send a written notice to our designated agent that includes: (a) a description of the copyrighted work you claim has been infringed; (b) a description of where the allegedly infringing material is located on the Services; (c) your contact information; (d) a statement that you have a good faith belief that the use is not authorized; (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf; and (f) your physical or electronic signature. Notices should be sent to our designated agent at: info@apexreport.org .

11. Third-Party Links and Content

The Services may contain links to, or embed content from, third-party websites, such as social media posts, videos, or partner content related to real estate listings, auto shows, or travel providers. These links and embeds are provided for your convenience only. ApexReport does not control and is not responsible for the content, privacy practices, or availability of any third-party site, and inclusion of a link does not imply endorsement.

12. Advertising and Sponsored Content

The Services may display advertising, including from Google AdSense and other advertising partners, as described in our Privacy Policy. We may also publish sponsored content or content produced in partnership with advertisers, which will be labeled as such in accordance with applicable advertising disclosure guidelines. ApexReport is not responsible for the products, services, or claims made by advertisers or sponsors.

13. Membership and Paid Content 

Certain content and features require a paid membership. Fees, billing intervals, and renewal terms are presented at checkout. You are responsible for maintaining accurate account information and for all activity under your account.

14. Limitation of Liability

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless ApexReport and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Services, your User Content, or your violation of these Terms.

16. Dispute Resolution; Arbitration Agreement; Class Action Waiver

You and ApexReport agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services (a “Dispute”) will be resolved by binding arbitration on an individual basis, rather than in court, except that either party may bring an individual action in small claims court, or seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.

Arbitration will be administered by the American Arbitration Association under its rules then in effect. The arbitration will be conducted in a mutually agreed location, or, if the parties agree, by videoconference or based on written submissions. This arbitration agreement will survive termination of these Terms.

17. Governing Law and Venue

These Terms are governed by the laws of the , without regard to its conflict of laws principles. Subject to Section 16, any action not subject to arbitration will be brought exclusively in the state or federal courts, and you consent to the personal jurisdiction of such courts.

18. Termination

We may suspend or terminate your access to all or part of the Services at any time, with or without cause, and with or without notice. Provisions of these Terms that by their nature should survive termination (including Sections 6, 10, 13, 14, 15, and 16) will survive.

19. Changes to These Terms

We may revise these Terms from time to time. The “Last Updated” date above reflects the most recent revision. Your continued use of the Services after any changes take effect constitutes your acceptance of the revised Terms. If we make material changes, we will provide additional notice where required by law.

20. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and ApexReport regarding the Services.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
  • No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
  • Force Majeure: ApexReport will not be liable for any failure or delay resulting from events beyond our reasonable control.
